For example, to use the OneSmartLab.com API service, we may collect, store, and access one or more of the following: (1) an email address; (2) photos or video that you upload through the application or otherwise provide to us; and (3) a biometric template, comprised of a list of numbers created by us from the photos or videos you uploaded. In addition we will store any information you provide to our sales department within one of our contact forms.

The personal information we collect from you will be used to provide the service(s) or carry out the transaction(s) you have requested or authorized. In support of these uses, we may also use personal information to provide you with more effective customer service, and to improve our products or services. We may also use your email address to contact you regarding administrative notices from time to time. Information that is collected by or sent to us may be stored and processed in the United States, Canada, or any other country in which we or our affiliates, subsidiaries or agents maintain facilities. By using any of our products or services, you consent to any such transfer of information outside of your country.

We may use demographic information collected from you during the registration or purchase process (including age, location and gender data) or aggregate information from all of our users and provide that information in the aggregate to other parties, including advertisers, for marketing and promotional purposes. Your Websites and Applications
The OneSmartLab.com APIs are designed to help you enhance your services, websites and applications. YOU AGREE THAT OneSmartLab.com MAY MONITOR USE OF THE APIS TO ENSURE QUALITY, IMPROVE TRUEFACE’S PRODUCTS AND SERVICES, AND VERIFY YOUR COMPLIANCE WITH THE TERMS. OneSmartLab.com may suspend access to the OneSmartLab.com APIs by you without notice if we reasonably believe that you are in violation of the Terms.

Your User Agreement and Privacy Policy
If you offer your services for use by others outside your organization, you must maintain a user agreement and privacy policy for your such services, which is prominently identified or located where users download or access your services. Your privacy policy must meet applicable legal standards and accurately describe the collection, use, storage and sharing of data. Your privacy policy must be at least as stringent and user-friendly as ours.

End User Data
You must delete all data you have collected from an end user via the OneSmartLab.com API user upon request by that user, and when the end user deauthorizes your services or closes his or her account with you.

Media Data Policy
OneSmartLab.com customers submit images and videos to our our API services.

OneSmartLab.com’s Face Recognition API processes submitted images or videos from each of our customers to provide facial coding analysis on faces identified in the image video.

Disclosure of Information
Except as described in this statement, personal information you provide will not be transferred to third parties without your consent.

We do not sell or rent any personally identifiable information about you to any third party. In addition, we must (and you authorize us to) disclose any information about you to private entities, law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate to address or resolve inquiries or problems, or comply with court orders, information requests from government agencies, or other legal or regulatory actions.

This Privacy Policy applies if you are a visitor to the OneSmartLab.com site or if you sign up for the services. If you use a third party application or service that is integrated with OneSmartLab.com, then such third party’s privacy policy will govern the use, storage and disclosure of your data in connection with such application or service. OneSmartLab.com may receive orders, subpoenas or other legal demands for Personally Identifiable Data that has been collected on behalf of such third party providers through the use of their applications or services. In such cases, OneSmartLab.com refers the party requesting the Personally Identifiable Data to the applicable third party provider. While OneSmartLab.com strives to protect your Data, OneSmartLab.com does not guarantee its security.

OneSmartLab.com does not share or disclose any of your Personally Identifiable Information, except as described in this section. Even though all steps are taken to maintain privacy and data integrity when these third party transfers take place, OneSmartLab.com does not assume liability once these transfers have taken place.

(a) Agents, consultants and related third parties: OneSmartLab.com uses third party vendors to perform certain business-related functions. Examples of such functions include data storage services, database maintenance services and payment processing. When OneSmartLab.com employs such third party vendors to perform services on its behalf, OneSmartLab.com will only provide them with the Personally Identifiable Information that they need to perform their specific function. Each third party vendor is required to keep such Personally Identifiable Information confidential and not to use such Personally Identifiable Information for any purpose other than providing services to OneSmartLab.com.
(b) Affiliates: OneSmartLab.com may share Personally Identifiable Information with entities that control, are controlled by or under common control with OneSmartLab.com (each, an “Affiliate”) for the purpose of assisting OneSmartLab.com in providing its Services to you. OneSmartLab.com has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. In compliance with the Privacy Shield Principles, OneSmartLab.com commits to resolve complaints about our collection or use of your personal information. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact OneSmartLab.com at: support@OneSmartLab.com. OneSmartLab.com has further committed to refer unresolved Privacy Shield complaints to EU Data Protection Authorities, an alternative dispute resolution provider located in the EU. The right of individuals to access their personal data: The end user has access to their testing data via the members area. To access this area they must login at the member’s area. They also have access to all identity verification data via this portal. For those sending images via the API, the individual has the right to request access to this data, and OneSmartLab.com is obliged to provide a copy of this data, free of charge, in electronic format. In addition, the individual has the right to amend, correct or delete this data, including the original.

The choices and means that OneSmartLab.com offers individuals for limiting the use and disclosure of their personal data: The end user has the right of limitation of use and disclosure of their personal data. Once agreeing to use the OneSmartLab.com services, this is an agreement to allow their data to be used and processed for the methods laid out in this privacy policy. If an individual requires to limit the use and disclosure of their personal data, they must contact OneSmartLab.com at support@OneSmartLab.com and OneSmartLab.com is obliged to meet these demands.
